This contract is made and entered into by and between the undersigned Lessee, and Premier Bounce N Slide Party Rentals LLC, hereafter known as the Lessor and is mutually agreed the contract shall be subject to the information in this contract.
PARTIES: The Lessee hereby engages Lessor who agrees to furnish the items described upon the terms and condition forth herein.
DEPOSIT: The deposit shall be secured by a credit card to Premier Bounce N Slide Party Rentals LLC, to reserve time, date and equipment. In the event of a cancellation, 25% of the rental cost will be charged. This fee is not refundable; however, it can be applied to another
rental if canceled at least 14 days prior to the rental, and used within 90 days.
BALANCE: We accept cash, checks and VISA/MasterCard. (Credit Cards are subject to a 5% surcharge.) LESSEE INITIALS ___________
TIMING & FEES: The reserved rentals shall be delivered no later than 30 minutes before the requested start time unless both parties agree upon other arrangements. All rentals will be picked up at the time stated above unless both parties agree upon other arrangements.
SPECIAL PROVISIONS: The Lessor reserves the right not to perform outdoor engagements when, in the Lessors judgment, weather conditions would be detrimental to the Lessors equipment. This includes but is not limited to wind, rain or mud.
Lessor is Not responsible for any damage to narrow entrances or gates in order to deliver equipment to setup location, some items are very large on dollys.
§A representative from the Lessor will contact the Lessee prior to delivering the equipment if the weather is questionable. Once the equipment arrives at the event, payment is due in full. At the time of this call, if the Lessee chooses not to have the equipment delivered due to weather concerns, you will have 90 days to reschedule the event. Lessor is not resposible for any damage to irrigation/underground pipes, conduits, or buried lines. Lessee agrees to properly mark lines so no damage occurs. Lessor is not responsible for injury caused by any stake or device used to secure items. Please use caution and stay clear from stakes securing items rented.
NEGLIGENCE OR ABUSE: Lessee agrees to be responsible for any damage to Premier Bounce N Slide Party Rentals LLC equipment, if damage is incurred with the equipment in the possession of the Lessee. Damage fees vary but are estimated below:
Bounces & Slide:
$ 25 - $ 250 for cleaning fees (includes: silly string; gum; food; candy; excess dirt, mud & rust stains)
$ 200 - $ 1,200 for repairs (cuts, tears & holes)
$3,500 - $10,000 if the unit is not repairable
NO WELL WATER CAN BE USED ON WATERSLIDES IF IT IS UNFILTERED OR HAS ANY RUST IN IT.
NO SILLY STRING, WATER BALLOONS, GUM, FOOD, DRINKS, ANIMALS, SHOES, OR SHARP OBJECTS ARE ALLOWED IN THE RENTALS AT ANY TIME.
DO NOT DEFLATE UNIT (WILL RESULT IN AN ADDITIONAL CHARGE.)
NO MORE THAN TWO PERSONS ON THE WATER/DRY SLIDES AT ANY TIME.

RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
IN CONSIDERATION OF THE FOREGOING LEASE, LESSEE ACKNOWLEDGES AND AGREES FOR HIMSELF, HERSELF, ITSELF AND ANY PERSONAL REPRESENTATIVES, HEIRS AND NEXT OF KIN THAT HE, SHE OR IT ASSUMES FULL RESPONSIBILTY FOR THE SAFE USE AND OPERATION OF THE PROPERTY LEASED HEREIN DURING THE ENTIRE TIME THAT THE PROPERTY IS UNDER LESSEES CARE, CUSTODY OR CONTROL. LESSEE WARRANTS AND REPRESENTS THAT HE, SHE OR IT WILL, AT ALL TIMES, SUPERVISE THE SAFE USE AND OPERATION OF THE PROPERTY LEASED HEREIN. LESSEE FURTHER AGREES THAT HE/SHE/IT IS RESPONSIBLE FOR THE FULL VALUE OF THEIR PROPERTY LEASED HEREIN IN THE EVENT THE PROPERTY IS LOST, STOLEN OR DAMAGED WHILE IN LESSEES CARE, CUSTODY OR CONTROL. LESSOR MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, ABOUT THE SAFETY OF ANY OF THE PROPERTY LEASED.
IN FURTHER CONSIDERATION OF THIS LEASE:
LESSEE HEREBY RELEASES, WAIVES AND DISCHARGES LESSOR, INCLUDING ITS AGENTS, SERVANTS, EMPLOYEES, OFFICER, DIRECTORS AND SHAREHOLDERS FROM AND AGAINST ANY AND ALL CLAIMS FOR DAMAGES SUFFERED BY ANY PERSON OR ENTITY CONNECTED WITH THE USE OR OPERATION OF ANY OF THE PROPERTY LEASED HEREIN. THIS RELEASE IS INTENDED TO INCLUDE, BUT IS NOT LIMITED TO, LIABILITY DUE TO LESSOR'S NEGLIGENCE; REGARDLESS OF WHETHER SUCH NEGLIGENCE IS ACTIVE OR PASSIVE. THIS RELEASE IS INTENDED TO DISCHARGE LESSOR FROM ALL LIABILTY FOR ANY INJURY TO ANY AND ALL PERSON(S) AND ANY AND ALL PROPERTY CONNECTED WITH THE LEASE OF THE PROPERTY SPECIFIED HEREIN. THIS INCLUDES BUT IS NOT LIMITED TO: PROPERTY DAMAGE, LOSS OF THE USE OF PROPERTY, PHYSICAL INJURY, DEATH, ENJOYMENT OF LIFE, LOSS OF PROFITS, INJURY TO GOODWILL, INJURY TO REPUTATION AND ALL OTHER FORMS OF CONSEQUENTIAL INJURY AND DAMAGE, REGARDLESS OF HOW SUCH INJURY OR DAMAGE IS CALLED OR CHARACTERIZED. LESSEE WAIVES ALL RIGHTS TO SUE PREMIER BOUNCE N SLIDE PARTY RENTALS LLC FOR ANY INJURY A CHILD OR ADULT MAY SUFFER DUE TO NEGLIGENCE OR ANY OTHER CAUSE.
LESSEE SHALL BE IN FULL CHARGE OF THE SAFE USE AND OPERATION OF THE PROPERTY LEASED HEREIN AND PROMISES AND AGREES TO INDEMNIFY AND HOLD LESSOR, INCLUDING ItS AGENTS, SERVANTS, EMPLOYEES, OFFICERS, DIRECTORS, AND SHAREHOLDERS, HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS DEMAND, EXPENSES AND LIABILITYS ARISING, OR WHICH MAY ARISE, FROM THE USE AND OPERATION OF THE PROPERTY LEASED HEREIN.
LESSEE FURTHER EXPRESSLY AGREES THAT THE FOREGOING RELEASE, WAIVER AND INDEMNITY AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY LAW AND THAT IF ANY PORTION OF THIS AGREEMENT IS DETERMIND TO BE INVALID BY A COURT OF COMPETENT JURISDICTION, THEN THE REMAINDER OF THIS AGREMEENT SHALL REMAIN IN FULL FORCE AND EFFECT.
THIS AGREEMENT REPRESENTS THE ENTIRE AGREEMENT OF THE PARTIES CONCERNING THE SUBJECT MATTERS ABOVE. THERE ARE NO OTHERS. LESSEE UNDERSTANDS AND AGREES THAT NO ORAL REPRESENTATIONS OR STATEMENTS HAVE BEEN MADE BY LESSOR TO REPRESENTATIONS SET FORTH HEREIN.
DUTY TO MITIGATE - IN THE EVENT OF INJURY, DAMAGE OR LOSS DUE TO LESSORS NEGLIGENCE, LESSEE AGREES AND ASSUMES THE DUTY TO MITIGATE ALL COSTS RESULTING FROM SAID INJURY, DAMAGE OR LOSS.
DISCLAIMER OF CONSEQUENTIAL DAMAGES - BY SIGNING THIS CONTRACT, LESSEE AGREES TO FOREGO SEEKING ANY CONSEQUENTIAL DAMAGES IN THE EVENT OF ANY INJURY DAMAGE OR LOSS DUE TO LESSORS NEGLIGENCE.
DISCLAIMER OF WARRANTIES - LESSOR MAKES NO WARRANTIES EITHER EXPRESSED OR IMPLIED AS TO THE CONDITION OR PERFORMANCE OF ANY EQUIPMENT AND/OR PROPERTY LEASED BY LESSEE FROM LESSOR. BY SIGNING THIS CONTRACT, LESSEE AGREES THAT ANY WARRANTY OF MERCHANTABILITY OR FITNESS OF A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED BY SIGNING THIS CONTRACT, LESSEE AGREES THAT NO EXPRESS WARRANTY AS TO THE CONDITION OR PERFORMANCE OF ANY EQUIPMENT AND/OR PROPERTY LEASED BY LESSEE IS HEREBY DISCLAIMED.
MERGER CLAUSE- THIS SIGNED CONTRACT INCOMPASSES THE ENTIRE AGREEMENT BETWEEN THE LESSOR AND THE LESSEE. NO AMENDMENT, WHETHER FROM PREVIOUS OR SUBSEQUENT NEGOTIATIONS BETWEEN THE LESSEE AND THE LESSOR, SHALL BE VALID OR ENFORCEABLE UNLESS IN WRITING AND SIGNED BY ALL PARTIES TO THIS CONTRACT. THE INVALIDITY OR UNENFORCEABLITY OF ANY PARTICULAR PROVISION OF THIS AGREEMENT SHALL NOT EFFECT THE OTHER PROVISIONS HEREOF.

Operating Procedures
Each operator should read and understand the following instructions:
1. The ride should not be operated if winds exceed 25mph or in rain or lighting conditions.
2. All riders must remove their shoes.
3. Riders should be sorted by size. Only riders of the same size should be allowed in the ride at the same time.
4. Riders must remove loose or sharp objects including glasses and dangling jewelry. Glasses should be removed.
5. No silly string, shoes, food, drink or gum.
6. The rated capacity should never be exceeded. The capacity of the ride is as follows:
a. Bounce Houses
i. Small children: 6 to 8
ii. Medium children: 4 to 6
iii. Teens or Adults: 2 to 4
b. Slides (Dry/Water)
i. Single Lane Slides - 1 rider at a time / Dual Lane Slides - 2 riders at a time (One per lane)
ii. Riders are not to slide down until the landing area is clear
c. DO NOT LEAVE RIDE UNATTENDED.
7. The operator should assist the riders when they enter and exit the ride.
8. The operator should position himself/herself in close proximity to the entrance of the ride.
9. While the ride is in operation, the operator should watch the riders at all times. No rough housing or horseplay should be tolerated. No climbing on the nets is allowed. Anyone who does not obey the rules after being warned should be asked to exit the ride. Operators should be made to understand that they are in control of the ride and removing someone from the ride who is not following the rules is important for the riders safety.
10. The operator must strictly enforce the rules posted on the warning sign(s).
11. The operator should assist the riders while they exit the ride.
12. The operator must remain in control of the ride at all times.
Emergency Procedures
Emergencies can arise for various reasons. The following are a few examples of emergencies and how they can be handled. This is strictly a guide; please use common sense when an emergency occurs.
Weather: Bad weather can arrive in the form of lightning or strong wind. In each case you want to evacuate the ride as quickly and safely as possible. REMAIN CALM. If you panic your riders may also panic. Stay calm and stay focused on you job, which is to help your riders exit the ride quickly and in an orderly fashion. After everyone has exited the ride, deflate the ride by turning off the blowers or fans.
Loss of Electrical Power: When a loss of power occurs the ride will slowly start to deflate. REMAIN CALM. You will have ample time to help your riders quickly and safely exit the ride. This situation tends to cause panic, unless the operator stays calm and relaxed. Talk calmly to those inside the unit telling them not to panic while you are helping them walk out. Check to see if the blowers have come unplugged or the cords are unplugged from the outlet. If so, plug them back in and the ride will re-inflate. Contact or have someone contact Premier Bounce N Slide Party Rentals LLC at 954-300-3357 to check the problem. DO NOT LEAVE THE RIDE UNATTENDED.
Damage: If the ride becomes damaged while in you operation, take the following steps:
· If the ride is ripped or otherwise begins to lose air, assist all riders from the ride and deflate it.
· Write down what happened, when and any other details you observed and turn this report in the Responsible Party.
· Contact the Premier Bounce N Slide Party Rentals LLC immediately. Do not attempt to continue to operate the ride.
